Creator Program Terms of Participation

1. Parties & Program

These terms govern participation in the Creator Program (the “Program”) operated by [COMPANY NAME], [COMPANY ADDRESS], [COMPANY REGISTRATION NO.] (the “Operator”) on cheaptrips.ai (the “Platform”). A “Creator” is a registered user whose Program application the Operator has expressly approved. There is no entitlement to admission; approval is at the Operator’s discretion.

2. How the Program works

Creators publish travel itineraries on the Platform, optionally accompanied by a link to their own social-media video. When other users open a Creator’s shared itinerary, booking links on that page carry the Creator’s referral identifier. When such a link leads to a completed, non-cancelled booking with one of the Operator’s affiliate partners, the partner pays the Operator a commission (“Attributable Commission”).

3. Eligibility

Payout eligibility requires all of the following:

• an approved Creator application (identity and social-profile verification by the Operator);
• at least 3 distinct copies (“clones”) of the Creator’s shared itineraries by other users;
• a valid payout reference on file and acceptance of the then-current version of these terms.

4. Revenue share & payment

• The Creator receives 30% of the net Attributable Commission actually received and retained by the Operator (i.e. after partner-side cancellations, reversals, and clawbacks).
• Settlement is monthly in arrears, calculated per calendar month, payable within 30 days of month end.
• Amounts under €25 roll over to the following month.
• No commission is due on the Creator’s own bookings, self-dealing, or traffic generated through prohibited means (§6).
• The Operator’s records (affiliate-partner reports per referral identifier) are the basis of calculation; the Creator sees their ledger in their account.

5. Taxes & status

Creators participate as independent parties, not as employees, agents, or partners of the Operator. Creators are solely responsible for declaring and paying any taxes and social charges on amounts received, and for any registration obligations that apply to them.

6. Content & conduct

• Creators warrant that shared itineraries and linked videos are their own content and infringe no third-party rights.
• Creators must disclose their commercial relationship with the Platform where required (e.g. advertising labels on social posts).
• Prohibited: incentivized/fraudulent bookings, self-clicking or automated cloning, misleading claims about prices or availability, and any unlawful content. Violations forfeit unpaid amounts and terminate participation.

7. Data protection

The Operator processes the following Creator data for Program administration and payout execution: display name, social-profile URL, payout method and reference, referral identifier, consent timestamp, and aggregated performance figures (clones, attributable commission). Legal basis: performance of this agreement (Art. 6(1)(b) GDPR). Data is retained for the duration of participation plus statutory retention periods, then deleted. Creators may access, correct, or (subject to statutory retention) request deletion of their data at any time via the contact in the Platform’s privacy policy (Datenschutzerklärung).

8. Term, changes, termination

• Either party may end participation at any time with effect for the future; accrued, non-forfeited amounts above the minimum threshold are settled in the next cycle.
• The Operator may amend these terms with notice; continued participation after notice constitutes acceptance. Material changes to the revenue share apply prospectively only.

9. Final provisions

These terms are governed by the laws of [JURISDICTION]; mandatory consumer protections of the Creator’s habitual residence remain unaffected. Place of jurisdiction: [VENUE], to the extent permitted. Should individual provisions be invalid, the remainder stays in force.
